Terms and Conditions
Terms and Conditions.
Please read our terms and conditions carefully. Your use of the LOXX WEB SITE and purchase of our products on it means that you agree to the following terms and conditions.
Shopping with LOXX
1. When you place an Order for a Product you are agreeing to buy it for the price stated, subject to these Terms.
2. Orders will not be dispatched until your payment has been cleared.
3. When you place an Order online we will send you an email to confirm that we have received your order. The email confirmation will be produced automatically so that you have confirmation.
4. The receipt of an automatic confirmation does not mean that we will be able to meet your Order and may be subject to stock being sold out. If a Product is not available we will attempt to let you know via email.
5. LOXX reserves the right to cancel any sale and not supply products if it is reasonable to do so and may change or discontinue the availability of Products at any time at its sole discretion. If an order is cancelled, any payment made for the Products will be refunded in full. This does not affect your Statutory Rights.
6. All new Orders are deemed separate and each is treated individually.
7. We endeavour to ensure that all prices on LOXX are accurate but errors may occur. If we discover an error in pricing of the Products in your order we will inform you as soon as possible using the contact details you have supplied us with. We will then give you the option of re-confirming your Order at the correct price or cancelling it. (If we are unable to reach you we will treat the Order as cancelled). If an Order is cancelled, any payment made for the Products will be refunded in full.
8. Prices are quoted on LOXX in UK Pounds Sterling - outside the UK your credit card company will charge you in your local currency at their stated rate of exchange. Please note that both charges and refunds are in UK Pounds Sterling and LOXX cannot be held responsible for any loss due to exchange rate fluctuations.
9. Non-EU customers are responsible for Import Duty/Tax in their respective countries. Unfortunately we cannot advise you what these costs will be - please consult your local customs office for more information.
10. You must pay for your Order before it is delivered and you can do so by credit card, debit card or PayPal. We cannot guarantee that these external payment systems will always be on-line and in working order.
11. We will always strive to keep LOXX as up to date as possible but cannot guarantee that a particular Product will always be available. If we are unable to supply a Product you will be refunded for it or given the option to choose another item of the same price. LOXX has endeavoured to make the descriptions (including all images) of the Products as accurate as possible but we cannot be held responsible for any changes made by the relevant manufacturer.
12. All offers are available subject to stocks levels. If we are unable to supply a Product you have Ordered, we will notify you via contact details you have supplied, where possible, and will either refund you for that item, give you the option to select another item of the same value or provide you with further information regarding stock availability. LOXX delivers to destinations inside and outside the UK.
13. Delivery outside the EU may be subject to local taxes, which are solely your responsibility when they apply. We are unable to supply you with advice what these charges will be and LOXX is not responsible for them.
14. Orders are dispatched via Royal Mail (1st Class) Packet or Parcel post, Recorded Delivery or courier depending upon the value/size/weight at LOXX’s discretion, and are normally delivered within 96 working day hrs. Sometimes postage delays may occur for which LOXX cannot be held responsible.
15. Non-UK delivery restrictions: LOXX cannot process orders if the total contents weight exceeds certain limits. The Airmail limit is 1500 ML/MG and the Surface Mail limit is 400 ML/MG. In addition it is not possible to ship Aerosol products via Airmail.
16. Whilst LOXX will make every effort to deliver goods within times stated we will not be liable for any loss caused to you by late delivery especially during busy periods such as Christmas.
17. This does not affect your Statutory Rights as the consumer.
18. Copyright and Trade Marks
a. All content of this site, including text, images, source codes, logos, icons and photos and all other material, is the property of LOXX or its content providers and is protected by the United Kingdom and international copyright laws.
b. The site is for personal use only and users may not exploit any part of the content in any way without the express written permission of the copyright owner. All rights reserved.
c. Permission is given to print and electronically copy parts of the LOXX site for the sole intention of placing an order with LOXX and to use the site as a shopping resource. Any other use of the LOXX website and its materials, including reproduction for purposes other than those stated above, modification, distribution, or re-publication without the prior written permission of LOXX, is strictly prohibited.
d. LOXX does not make any warranty or representation in respect of any other trade mark and the trade marks of the brands featured on LOXX belong to their respective owners
19. Privacy and Data Protection
a. LOXX is committed to protecting your privacy and promises only to use information collected about you in accordance with the Data Protection Act 1998.
b. When you place an Order, we may ask you for certain information and you may submit data to LOXX (for example your phone number, name, postal address, email address, contact and bank/credit card details). We may also record which Products you are interested in and which Products you purchase as well as customer traffic patterns and site use. This information may be used to: 1) process your Order 2) provide you with an up to date, efficient and reliable service 3) help to prevent fraud i.e. we check card details with our merchant card checking facility and reserve the right to refuse Orders on that basis 4) open and run your membership information 5) provide a more bespoke shopping experience to meet your needs.
c. By making an Order and submitting your data you agree to this use.
d. We will not request or collect sensitive information about you without your explicit consent.
e. At no time will any information gained about you be passed on to any third-party for marketing purposes.
20. Returns
a. We accept goods back, for any reason, and will make a full refund excluding P&P, within 21 days of your order placement provided that the goods have been unopened and unused and are in a re-saleable condition. By this we mean that all packaging and or cellophane wrapping and tamper resistant seals must be intact. Sometimes manufacturers will apply a security seal to the outside of a box, for example GHD styling irons, if this seal is broken the item cannot be re-sold and will not be accepted by our Returns Dept. b. If you have received the wrong goods, LOXX will make sure that you receive the correct goods at no extra cost, and will bear all costs for the return of the products. Please contact info@hsmsalons.co.uk to arrange this.
